Fixing or Terminating Problem Trusts

Glenn Karisch is an expert in helping clients deal with trusts which are broken or have outlived their usefulness. He has presented his paper on Modifying and Terminating Irrevocable Trusts to attorneys at multiple continuing legal education seminars.

Some families are sold living trust packages by unscrupulous companies and individuals.  This is a big problem, and the best way to deal with it is to avoid it in the first place. (See this frequently asked question on The Texas Probate Web Site and this Living Trust Scams brochure from the Texas Young Lawyers Association for more information.) Unfortunately, some Texans don't avoid these plans, and they or their loved ones must deal with repairing the damage.  The Karisch Law Firm, PLLC, can help by replacing the trust with a workable, affordable estate plan if there is time, or by unraveling the mess if it is too late to change the plan.

Since trusts -- even well-drafted ones -- often last for years, they may fail to address current circumstances. It is impossible for the person creating a trust to anticipate everything that will happen years in the future. If you are the trustee or a beneficiary of a trust which has a problem, contact The Karisch Law Firm, PLLC, to see if we can help you get a court to modify or terminate the trust.
